Rules for the sale of goods

1. General provisions

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”), after approval by the Buyer (after getting acquainted with the Rules and ticking the box “I Agree to the Terms of Purchase”), are a binding legal document for the Buyer and the Seller. , terms of payment for them, the procedure of delivery and return of goods, liability of the parties and other provisions related to the purchase and sale of goods in the www.zenoteca.lt online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time.
1.3. Active natural persons, not less than 20 years of age and legal entities have the right to buy in the www.zenoteca.lt e-shop, without violating the age requirement.

2. Protection of personal data

2.1. www.zenoteca.lt has the right to collect and process personal data provided by the Buyer when purchasing goods and, if necessary, to disclose them to third parties when it is necessary for order fulfillment, data processing or www.zenoteca.lt business planning and analysis. Data about Online Store Buyers and Visitors is protected from loss, unauthorized use and alteration. The data carriers are fully protected from third party access.

3. Entry into force of the purchase and sale agreement

3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the item (s) to be purchased and formed a shopping cart, clicks on the “Buy” link.
3.2. www.zenoteca.lt is not obliged to separately notify the Buyer of its consent to enter into the contract. www.zenoteca.lt is considered to confirm the order from the moment it starts to be executed.

4. Buyer’s rights

4.1. The Buyer has the right to purchase goods in the www.zenoteca.lt online store in accordance with these Rules and the online store.
4.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded with the www.zenoteca.lt online store by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) no later than within 7 (seven) working days of the item. delivery dates, unless the contract is for
4.2.1. the supply of books, newspapers, magazines or other periodicals;
4.2.2. purchase of alcoholic beverages;
4.2.3. goods that have been manufactured taking into account the personal needs of the Buyer or according to the conditions provided by the Buyer;
4.2.4. food products, if a food product of appropriate quality has been sold to the Buyer and the expiration date of the product has not expired;
4.2.5. goods which cannot be returned according to their characteristics, including perishable goods and products which have expired;
4.2.6. in other cases, when the purchase and sale agreement cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
4.3. The Buyer may exercise the provided right only if the product has not been damaged or its appearance has not substantially changed, nor has it been used.

5. Obligations of the Buyer

5.1. The Buyer must accept the goods in accordance with these Rules and pay the agreed amount for them.
5.2. If the data provided by the Buyer in the registration form changes, he must update them immediately.
5.3. The buyer undertakes not to pass on his login details to third parties. If the Buyer loses the login data, he must immediately inform the Seller about it by the means of communication specified in the “Contacts” section.
5.4. The Buyer, using the www.zenoteca.lt online store, undertakes to comply with these Rules and not to violate the legal acts of the Republic of Lithuania.
5.5. If the Buyer, at the time of delivery of the goods, refuses to accept the goods without important reasons, the Buyer must cover the costs of delivery of the goods.

6. Seller’s Rights

6.1. If the Buyer attempts to compromise the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend his access to the online store or, in exceptional cases, cancel the Buyer’s registration.
6.2. In the event of significant circumstances, the Seller may temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.
6.3. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen the delivery method “Pick-up in the store” or another place provided as a delivery option on the www.zenoteca.lt page, does not take back (and / or pay) the goods within 3 (three) Work days.
6.5. www.zenoteca.lt has the right to withdraw from the concluded Purchase-Sale Agreement if the stock of goods specified in the Agreement has run out, as well as if the Agreement was concluded by a person who was not entitled to conclude the Agreement in accordance with these Rules.

7. Obligations of the Seller

7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store www.zenoteca.lt under the conditions set forth in these Rules and the online store.
7.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
7.3. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept a similar or most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if the advance payment has been made.
7.4. The Seller undertakes to respect the Buyer’s right to privacy of the personal information belonging to him, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.

8. Prices of goods, payment procedure and terms

8.1. The prices of the goods in the online store and in the formed order are indicated in euros with VAT. www.zenoteca.lt reserves the right to change the prices of goods in case of changes in tax rates. The Buyer shall bear the increase in the price of the goods due to the changed taxes.
8.2. The buyer pays for the goods in one of the following ways:
8.3. Payment by e-mail banking is a prepayment when the Buyer pays using electronic banking through the Paysera electronic payment platform.
8.3.1 Payment in cash upon delivery of the goods does not apply.

9. Delivery of goods

9.1. The goods are delivered by the Seller or his authorized representative.
9.2. The Seller undertakes to deliver the goods to the Buyer in 1-3 working days. This term does not apply in cases when the Seller does not have the required goods in stock or pre-trades the goods. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to Force Majeure circumstances, as well as quarantine, state of emergency or other extreme circumstances.
9.3. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
9.4. The buyer undertakes to accept the goods himself. In case he cannot accept the goods himself and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding delivery of the goods to the wrong entity.
9.4.1. The buyer must guarantee the age of the host person (not less than 20 years).
9.5. During the delivery of the goods, the Buyer must check the condition of the shipment. If the Buyer signs the invoice (bill of lading) or other document of delivery-acceptance of the consignment, it is considered that the consignment has been delivered in proper condition.
9.6. Delivery fee and more detailed information:
9.6.1. Delivery of goods in Vilnius within 1 day – 5 Euros;
9.6.2. Delivery of goods in Vilnius in case the amount of the one-time purchase “basket” of goods exceeds 50 Eur, delivery in Vilnius is free of charge.
9.6.3. On the eve of delivery, we will receive an SMS message from zenoteca.lt about the delivery of the shipment, and on the day of delivery, a courier will contact you regarding the exact delivery time. Delivery of goods in Lithuania is paid – 5 Euros per shipment. Goods are not delivered to the Curonian Spit unless the parties agree individually.

9.7. In the event that the Buyer withdraws from the sales contract in accordance with these Rules, he shall be obliged to pay all direct costs of returning the goods to the Seller. The amount of these costs of the Seller shall be deducted from the refundable money paid to the Buyer for the goods.
9.8. If it is not possible to deliver the ordered goods in one shipment, then www.zenoteca.lt has the right to deliver the goods in several shipments.
9.9. The ordered goods can be picked up free of charge in the Zenoteca store: Užupio str. 25, Vilnius (within 5 working days).
9.10. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer’s control.

 

10. Product quality guarantee and expiration date

10.1. The characteristics of each product sold at www.zenoteca.lt are generally indicated in the product description attached to each product.
10.2 The Seller is not responsible for the fact that the goods in the online store may not correspond in color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the equipment used by the Buyer.
10.3. In the event that the Seller does not provide a guarantee of the quality of items for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
10.4. The Seller undertakes to sell the goods to the Buyer in such a way that he is given a real opportunity to use such goods before the expiry date. In case of extremely short warranty periods, the goods in the online store are marked with a special warning sign or sold on the condition that the ordered goods will be picked up in the Zenoteca store.
10.5. Goods that have a manufacturing defect (eg a cork defect in wine) may be returned, provided that the Buyer returns such item to the Seller within 3 business days. If the seller acknowledges that the product has a manufacturing defect, the product can be replaced with the same or a similar product.

11. Liability

11.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences. By filling in the registration form in the online store www.zenoteca.lt, the buyer confirms that he is at least 20 years old and assumes all possible losses related to the challenge of this fact and the consequences arising from it.
11.2. The buyer is responsible for the actions taken using this online store.
11.3. The buyer is responsible for transferring his login details to third parties. If the services provided by www.zenoteca.lt are used by a third party who has logged in to the online store using the Buyer’s login data, the Seller considers this person to be the Buyer.
11.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the Seller’s recommendations and its obligations, did not read these Rules, even though he was given such an opportunity.
11.5. If the Seller’s online store contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.
11.6. In the event of damage, the guilty party compensates the other party for the direct damage.

12. Exchange of information

12.1. The Seller sends all notifications to the e-mail address provided in the Buyer’s registration form.
12.2. The Buyer shall send all notices and questions by the means of communication specified in the “Contacts” section of the Seller’s online store.

13. Final provisions

13.1. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.
13.2. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
